The Cellar Exchange imposes limited control over the information that users present at this site. The Cellar Exchange is a service for the buyers and sellers of fine wine, and the completion of any auction is the responsibility of the Buyer and Seller exclusively. The Cellar Exchange takes no responsibility for the condition or quality of any items presented by Sellers, therefore, please exercise caution when using the website.
We have developed a Buyers Guide, a Sellers Guide and a Feedback Guide, to assist in using this site. The information contained in the Guides will help to explain the uses, the terms, and the responsibilities of the members of The Cellar Exchange.
Policies
- 1. All users must be 21 to buy or sell at this site.
- 2. The Cellar Exchange will be licensed in the States of Illinois to conduct internet wine auctions. The laws of the state where the auction is held shall govern the rights and obligations of all parties. Sellers of items must conform to all local laws, and all items sold must comply with local laws. It is the Buyer and Sellers responsibility to confirm that all laws are being complied with.
- 3. This site is meant exclusively for wine and wine related materials. Any other items may be removed without notice. Certain items are expressly forbidden and may NOT be listed for sale or auction on the site, including; Adult Material, Guns & Weapons, and Medications.
- 4. Nonpayment for items won or purchased can result in the suspension or termination of your privileges to buy and/or sell at The Cellar Exchange.
- 5. The Cellar Exchange disclaims any guarantees expressed or implied on items or services listed on our site, and does not in any way warranty the merchantability of items sold or purchased.
- 6. All sales are "as is" and no wine can be returned unless there is an arrangement made between buyer and seller. The Cellar Exchange Sales has NOT checked any of the wine for sale and cannot attest to the quality of the wine. Any guarantees provided are made strictly by the seller and not by the The Cellar Exchange.
- 7. If the Seller has in any way misrepresented their product, Buyer must deal directly with the Seller and not through The Cellar Exchange. It is recommended that you review the Sellers Feedback from prior sales.
- 8. The Cellar Exchange does not participate in any exchange of money or arrange for the delivery of any wine purchased through The Cellar Exchange. The details of the transaction must be completed by the Seller and the Buyer.
- 9. It is a violation of law to make bids in a false name or with an invalid credit card, even if The Cellar Exchange software initially accepts such a bid. Your web browser transmits a unique internet address which can be used by law enforcement officials to identify you. Your use of this site is your agreement to adhere to this rule, and acceptance that fraudulent bidders will be prosecuted to the fullest extent of the law.
- 10. The Cellar Exchange cannot be responsible for server down time, or any inability to access the site. In the event of technical problems, we reserve the right to cancel, restart, or extend an auction as the circumstances may dictate.
- 11. Notifications sent by email may take longer than expected, and cannot be counted on to inform you of an item's status.
Terms & Conditions
- 1. Bidders may place a "Maximum" bid and the auction will place their bids automatically until their maximum bid is met. If it is surpassed, an outbid notice will be sent via email. This service is for your convenience and by no means a requirement.
- 2. Bidders may contact sellers through the auction format to request pertinent information or ask additional questions about the item or wine consigned.
- 3. Sellers may place a reserve price on a wine listed for auction, and retain the right to "no sale" any wine if the minimum bid has not been met or surpassed.
- 5. The highest bidder will receive notice at the close of the auction. Unless otherwise specified by Seller, the cost of shipping is generally not included in the auction price. All shipping fees are to be paid by the Buyer unless other arrangements have been made between Buyer and Seller. All details of the transaction are the responsibilities of the Buyer and Seller. If Buyer has not made payment to Seller within the agreed amount of time as set by Seller, it will then be considered a default sale, may result in the termination of Buyer's privilege to use The Cellar Exchange for future purchases.
- 6. In the unlikely event a bid is not honored, the registered Buyer's registration and contract with The Cellar Exchange may be terminated. Seller may then request a resale of the wine in question or request The Cellar Exchange to accept the next highest bid on behalf of Seller. If any bid cannot be enforced, Seller hereby agrees that The Cellar Exchange is not responsible.
- 7. These terms and conditions of sale shall constitute a contract between all parties to this transaction, and shall be equally binding among all parties.
- 8. The Cellar Exchange has the right to decline any bids made by individuals who have defaulted in prior auctions or any individuals whose auction privileges have been terminated.
- 9. The Cellar Exchange may remove any listing, at its discretion, without notice.
